I-9 and New-Hire Compliance Review

Complete the form on time

The employee must complete Section 1 no later than the first day of employment. The employer generally completes Section 2 within three business days after the employee begins work for pay. For employment lasting fewer than three business days, Section 2 is due on the first day.

Use the current form: USCIS announced that beginning August 1, 2026, employers should use the Form I-9 edition displaying the May 31, 2027 expiration date. Always confirm the current edition on I-9 Central.

Document review

Employees choose which acceptable documents to present. Employers should not request a specific document or more documents than required. The person completing Section 2 must examine the presented documentation under the applicable physical- or alternative-procedure rules and record the information accurately.

Retention and audit controls

  • Retain each Form I-9 for three years after hire or one year after employment ends, whichever is later.
  • Maintain a reliable reverification calendar for time-limited employment authorization.
  • Correct errors transparently without backdating or concealing the original entry.
  • Limit access and store I-9 records separately when practical.
  • Apply E-Verify procedures consistently when enrolled or required.
